It has been observed that at the bow of the vessel the port anchor is hanging from the hawse pipe, while the starboard anchor is also suspended from the hawse pipe. The hull above the waterline at the bow, sides and stern, as well as the stern ramp used for the loading and discharge of wheeled vehicles and its ramp cover, are in moderate condition with average painting and maintenance. Below the waterline, the underwater hull is covered with heavy layers of algae and barnacles. The electrical panels and equipment on the bridge are in moderate condition. The electrical cable trays have been dismantled, and the cables are left exposed and scattered in a disorganized manner. Navigation and bridge equipment are present in their designated positions; however, the radio room, chart room and bridge area are poorly maintained and untidy, with the navigation console covers open and documents and charts scattered on the floor. The steel condition of the deck plating is moderate. The ship’s magnetic compass requires maintenance and calibration. The vessel’s lifeboats are present, however the davit of Lifeboat No. 6 is broken. The inflatable rescue boat with an outboard engine (Zodiac type) is deflated. On the bridge deck there are 6 life rafts on the port side and 7 life rafts on the starboard side, and their validity periods have expired. There are four deck cranes secured to the deck, and the luffing wires of the cranes are poorly maintained. The steel condition of the bridge deck is moderate, and painting and maintenance are required. All decks of the vessel require maintenance, painting and replacement works. The deck is dusty and maintained at a moderate level. Approximately 20 barrels of lubricating oil (CASTROL) are located on the deck, and some of the barrels have been opened. On the vehicle deck, the port-side hatch leading to the engine room, through which engine spare parts are lowered, is fully open, while the starboard hatch is half open. For occupational safety reasons, the area has been surrounded with barrels and safety straps to prevent the risk of falling. The bow thruster room and the emergency fire pump room have been inspected and require painting and maintenance. During the inspection of the steering gear room, it was observed that the steering gear equipment, emergency steering system and auxiliary equipment are present, and no temporary repairs were detected in the system circuits. However, painting and maintenance are required, and the oil tank tray and floor of the steering gear room are oily and slippery. The engine room was inspected; however, since no generator was operating on the vessel on the day of inspection, the examination was carried out with flashlight illumination. Upon entering the engine room, it was observed that it is poorly maintained and partially painted. Based on the general condition of the machinery, it appears that the vessel has not been operated for a long period of time. The jacket cooling water circuits of the main engines and generators have largely been renewed, but painting has not been completed. As routine maintenance of the machinery has not been carried out for a long period, no opinion could be formed regarding the seaworthiness of the vessel. A certain amount of bilge water is present in the engine room bilges. The paint condition of the port and starboard fin stabilizers is moderate, and painting and maintenance are required. On the forecastle deck, the port and starboard windlasses are in moderate condition and require painting and maintenance. The deck plating also requires painting and maintenance. The polyethylene mooring ropes show fiber breakage and deterioration and require renewal. One spare anchor is secured to the deck with clamps. On the aft deck, the port and starboard windlasses are in moderate condition and require painting and maintenance. The deck plating requires painting, and the mooring ropes show fiber deterioration and need to be replaced. The passenger lounges have been inspected. Passenger seats and seating groups are covered with plastic sheets, while some tables remain uncovered and covered with a thick layer of dust. 1- The first and second auctions shall be conducted by public auction through the Electronic Sales Portal (esatis.uyap.gov.tr) within the dates and times specified above. The property shall be awarded to the highest bidder provided that the bid submitted through the Electronic Sales Portal exceeds 50% of the appraised value of the property or, if higher, the total amount of the claims secured by that property and having priority over the claim of the creditor requesting the sale, and additionally covers the costs of realization and distribution.

2- In order to participate in the auction, a cash deposit corresponding to 10% of the appraised value of the seized asset must be deposited into the bank account of the enforcement office conducting the sale via the Electronic Sales Portal no later than 23:30 on the day preceding the end of the auction period.

If the security is provided in the form of a bank guarantee letter, a definite and irrevocable bank guarantee letter covering 10% of the appraised value must be submitted by the bidder or the issuing bank to the enforcement office conducting the sale no later than the end of working hours on the business day preceding the end of the auction period, either physically or electronically where the system infrastructure permits.

3- Persons wishing to participate in the auction through a representative must apply to the enforcement office conducting the sale together with their representatives no later than the end of working hours on the business day preceding the end of the auction period.

However, it shall be sufficient for the representative to present a power of attorney or document duly issued by notaries, public authorities or competent institutions within their authority and in accordance with the applicable procedure. In such case, the deposit must be paid to the enforcement office account at the time of application or the bank guarantee letter must be submitted to the enforcement office.

4- Where joint purchase is legally permissible, joint bidders wishing to purchase the property in specified shares must apply to the enforcement office conducting the sale no later than the end of working hours on the day preceding the end of the auction period, indicating their share ratios and the shareholder or representative who will submit bids on their behalf. Representatives holding a duly issued power of attorney or official authorization document may apply on behalf of the shareholders. In such cases, the deposit must be paid to the enforcement office account at the time of application or the bank guarantee letter must be submitted.

5- A creditor requesting the sale and participating in the auction, or in cases of dissolution of joint ownership by sale a shareholder participating in the auction, shall not be required to provide a deposit up to the amount covered by the creditor’s claim or share, provided that they apply to the enforcement office no later than the end of working hours on the business day preceding the end of the auction period. If the claim or share does not cover the required deposit, the deficient amount must be deposited into the enforcement office account at the time of application or secured by a bank guarantee letter.

6- Mortgagees/pledge creditors and other interested parties, if any, must notify the enforcement office of their rights over the vessel, particularly claims relating to interest and costs, together with supporting documents within fifteen (15) days. Otherwise, unless their rights are recorded in the vessel registry, they shall not participate in the distribution of the sale proceeds. This provision shall also apply to holders of easement rights.

7- The successful bidder must pay the full purchase price into the account of the enforcement office within seven (7) days from the date on which the auction result minutes are published on the Electronic Sales Portal.

8- If the successful bidder fails to pay the auction price within the prescribed period, the deposit shall not be refunded and shall first be deducted from the sale expenses, and any remaining amount shall be distributed to the entitled parties in proportion to their claims.

9- If the auction cannot be completed due to the minimum bid not being offered, or if the highest bidder fails to pay the auction price, the auction shall be cancelled and the second auction shall be conducted under the same conditions as the first auction.

10- All participants in the auction shall be deemed to have examined and accepted the conditions of sale together with all annexes.

11- Registration and delivery of the property shall be carried out after the auction becomes final.

12- VAT, stamp duty and all other expenses shall be borne by the purchaser. Accrued taxes shall be paid from the sale proceeds (without prejudice to Article 206/1 of the Enforcement and Bankruptcy Law and Article 21/2 of Law No. 6183 on the Procedure for the Collection of Public Receivables).
